1. Who operates the app

The Polonis Refractories app is operated by Polonis Refractories Sp. z o.o.

Polonis Refractories Sp. z o.o., Al. Marsz. Piłsudskiego 12, 43-100 Tychy, NIP 6463018057, REGON 540690200, KRS 0001150352, District Court Katowice-Wschód in Katowice, 8th Commercial Division of the National Court Register, share capital PLN 5,000.00.

In these Terms of use we refer to it as “we”.

Coretheus Sp. z o.o. runs the app technically on our behalf. It builds and maintains the app and holds the accounts with the technical services the app uses. Towards you, the app is always operated by Polonis Refractories Sp. z o.o.

The app is available at https://polonisrefractories.app, and the company website at https://polonisrefractories.com and https://polonisrefractories.pl. These Terms of use set out the rules for using it. What we do with your data is described in the Privacy policy.

2. Who may use the app

Accounts in the app are held by:

  1. the administration of Polonis Refractories;
  2. workers in Polonis Refractories crews employed under an employment contract or a civil-law contract;
  3. clients, that is, people from companies that work with Polonis Refractories. Each such company has its own organisation in the app, with an organisation owner and organisation members.

Only adults who are at least 18 years old may have an account, and only when invited by the administration of Polonis Refractories or by the owner of a client organisation into their organisation. There is no public registration.

An invitation is your email address entered on the list of invitations. Your account is created when you first sign in with that address.

Anyone can view the company website and the “Terms of use”, “Privacy policy”, “Cookie policy” and “Company details” pages, also without an account.

3. What the app is for and what it does not do

Polonis Refractories sends its own crews of bricklayers and helpers to carry out refractory work on industrial furnaces in various countries. The app brings together in one place what this work needs:

  1. planning projects: the crew for the day and night shifts, vehicles, accommodation, formalities and a timeline of projects;
  2. worker records with HR data: employment and rates, personal data, documents with their expiry dates and other files, seen only by the administration;
  3. assigning workers to projects and confirming participation;
  4. working hours and hours as a driver, which workers enter for themselves and as information for the administration, checking and closing each month, and a file of hours;
  5. the monthly register kept by the administration: working hours with the country of each day, advances, bonuses and deductions, the “Statement for the accountant” for the external payroll office, the payroll lists from that office and the payment mark; only the hours in this register count for the settlement of pay;
  6. sharing with workers their pay and register once the month is confirmed, and their balances, for example SOKA-BAU, with payouts from the balances;
  7. clients’ crew requests;
  8. project files and the client organisation’s chat with Polonis Refractories, including photos and files;
  9. photos documenting the work, which the administration and workers take with the app’s camera and send to the administration’s “Photo deposit”;
  10. announcements from the administration to workers;
  11. notifications in the app, by email and on the phone.

Everyone sees only what they are entitled to. A worker sees their own hours and balances, and their pay and monthly register once the administration has confirmed the month; of the other people in their project they see only the first name, surname and shift. Only the administration sees the workers’ HR data, its comments in the register and the “Photo deposit”. A client sees only the matters of their own organisation.

The app does not:

  1. replace the personnel files required by labour law: the worker record holds only the data and copies of documents that the administration needs to organise the work;
  2. calculate pay, contributions, taxes or amounts to be paid: the administration enters the amounts of the external payroll office’s payroll lists into it or loads them from a file;
  3. issue invoices or accept payments.

4. Signing in and quick access

You sign in with your email address, without a password: with a code or a link from a message that the app sends.

When signing in, you can tick “Remember me on this device”. You then set an App PIN, and on later visits you use quick access: you enter the App PIN or confirm with the device, for example with your fingerprint or face. The app does not receive an image of your face or your fingerprint. Do not tick this field on a shared computer or on someone else’s.

Anyone with access to your email inbox can sign in to your account. Therefore:

  1. protect your email inbox and do not share it with anyone;
  2. do not give your App PIN to anyone;
  3. do not let others use your account on a remembered device; if you turn on device confirmation, anyone who can unlock that device can also unlock the app;
  4. if you lose a device, disconnect it from another device on the “My account” page;
  5. if you lose access to your email inbox or suspect that someone else is using your account, tell the administration at once or write to contact@polonisrefractories.com.

5. Rules of use

  1. One account belongs to one person and works with that person’s own email address.
  2. Do not use another person’s account and do not share yours with anyone.
  3. Do not try to get around the app’s permissions or limits, for example to see data you are not entitled to.
  4. Do not post content that breaks the law or infringes other people’s rights, whether in the chat, announcements, crew requests or files.
  5. Only add files that you are entitled to share, and only files without harmful software.
  6. Send to the “Photo deposit” only photos that document the work (for example the state of a furnace, materials or the work done), also when you add them from the gallery.
  7. Do not photograph people who have not agreed to it, documents or number plates unless it is needed to document the work. Observe any ban on taking photos on the client’s premises.

Files are not checked by an antivirus program. You open downloaded files on your own device, so make sure it is protected.

6. Reporting unlawful content

If you see unlawful content in a file or in the chat in the app, write to contact@polonisrefractories.com. In your report, give:

  1. where the content is (for example the project, the crew request, the chat or the file name, the date and the author);
  2. a description of why you consider it unlawful.

We inform the person who sent the report of our decision on it. We may also remove content or a file on our own initiative. If we remove content or a file, we give the reason to the author of the removed content, by writing to their account’s email address.

7. Complaints

If the app does not work as these Terms of use describe, send a complaint to contact@polonisrefractories.com. Describe what it concerns and when the problem occurred. We send our answer by email to the address the complaint came from.

8. Availability, maintenance breaks and closing

The app works in a browser and needs an internet connection.

The app may have interruptions, including maintenance breaks during which it does not save changes. We do not promise uninterrupted operation.

We may close the app temporarily, for example when something threatens people’s data. Nobody can then sign in, and the app neither shows nor saves any data.

9. Ending the use

Deleting your account yourself

You can delete your account at any time on the “My account” page. Before that, you can download your data with the “Download my data” button.

Disabling an account by the administration

The administration can disable the account of a worker or an administrator, also when a worker stops working for Polonis Refractories. From the moment of disabling, you cannot sign in and you see nothing in the app, not even your own hours, pay and balances. We pass on your last pay and later balance changes to you outside the app. You can get a copy of your data by writing to contact@polonisrefractories.com. The administration can restore access.

Disabling a client organisation

The administration can disable a whole client organisation. Nobody from that organisation can then enter the app, and the organisation’s data remain.

Removal from an organisation

An organisation owner or the administration can remove another person from a client organisation. This deletes that person’s account and membership. Their chat messages, files and crew requests remain with their first name and surname.

What remains after an account is deleted

When an account is deleted, the following disappear: the account, the sign-ins on devices, quick access, phone notifications, settings and prepared files with your data.

The following in particular remain for the periods given in the Privacy policy:

  1. for a worker: the worker record with the PR number, the profile data and the HR data, assignments, hours, the register, pay and balances;
  2. shared matters (projects, crew requests, files, and chat messages with their photos and files) with the author’s first name and surname;
  3. the record of the acceptance of the Terms of use and of the declaration of being at least 18 years old;
  4. photos sent to the “Photo deposit” with the first name and surname of the person who sent them.

A new account with the same address is created only from a new invitation and has no access to the old data. The exception: when the administration re-invites a worker to the same worker record, their hours, pay and balances come back with it.

10. Changes to the Terms of use

We may change the Terms of use, for example when the app or the law changes. Each version has a number and the date from which it applies.

We announce a change that alters your rights or obligations in the app in advance, with the date from which it applies. Until that day, the current version applies. From that day, to continue using the app, accept the new version. If you do not accept it, you can download your data and delete your account.

A correction of the wording that does not alter anyone’s rights or obligations applies from its publication and needs no new acceptance.

11. Acceptance of the Terms of use and declaration of being at least 18

After your first sign-in, you will see these Terms of use. By selecting “I accept the Terms of use”, you accept them and declare that you are at least 18 years old. We record the number of the accepted version and the time of the acceptance and the declaration.

If you are not at least 18 years old, you may not use the app.

Until you accept the Terms of use, you do not use the app. An account without acceptance is deleted after 7 days; after that, you can sign in only after a new invitation.

12. Law and language versions

These Terms of use are governed by Polish law.

The Terms of use have three language versions: Polish, English and German. They have the same number and the same date. In case of any difference between them, the Polish version prevails.

You can download the Terms of use with the “Download the Terms of use” button.

13. Contact
